It seems though that this is actually a REAL issue for Duncan. We have a government agency that oversees these kind of things, and if they rule against this deal, Bain can’t do it. I’m really surprised this is a REAL issue for Duncan.

Romney’s investments are held in a blind trust set up in late 2002 before Romney took office as governor. The the Romneys had no knowledge of their current holdings and are forbidden under terms of the blind trust to direct the trustee to buy or sell investments.
